1. Introduction
Welcome to EverydayResourceCove ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at everydayresourcecove.sbs (the "Service") operated by EverydayResourceCove.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
EverydayResourceCove offers a range of upscale yacht charter services, such as:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Availability of all services depends on the vessel schedule and weather conditions. We may alter or halt services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For charter booking, the following is required:
- Minimum age of 18 years
- Accurate provision of necessary details
- Accomplishment of the requested down payment as noted in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A confirmation of booking is provided only after we receive your payment and issue a formal acknowledgment. We reserve the right to decline service at our own discretion.
3.3 Availability
Charter availability hinges on the allocation of the vessel and favorable weather conditions. We'll strive to accommodate your booking requests for preferred dates and times.
4. Payment Terms
4.1 Pricing
All quotes are denominated in € and incorporate all applicable taxes unless indicated otherwise. Prices are subject to modification without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total cost is payable at the time of booking
- Remaining balance: Due 48 hours prior to the charter's departure
- Incidental expenses (if any): Payable upon the charter's completion
4.3 Payment Methods
Accepted payment methods include major credit cards, bank transfers, and certified cheques. All payments are processed securely.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus transaction fees
- 24-72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund
5.2 Weather Cancellations
In the event the captain deems weather conditions unsafe, options include:
- Rescheduling to a new date without extra charges
- Issuing a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should there be any mechanical issues with the assigned boat, we'll aim to supply an appropriate substitution. If a replacement is unavailable, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must:
- Adhere to all instructions given by the crew
- Wear safety equipment as necessary
- Inform of any medical issues that could impact their safety
- Stay in the designated areas of the vessel
6.2 Prohibited Items
The following are not permitted on board:
- Glass items
- Illegal substances
- Firearms or weapons
- Pets (exceptions may be made with prior approval)
6.3 Conduct
Passengers are expected to behave respectfully. Should passenger conduct create risks or disrupt the experience for others, we may end the charter early without issuing a refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is limited strictly to the charter fee paid. We are not responsible for:
- Injuries incurred due to passenger carelessness
- Theft or damage to personal belongings
- Indirect, incidental, or punitive losses
- Delays caused by weather or other circumstances outside of our control
7.2 Insurance Coverage
We maintain full marine insurance for our fleet and operational activities. Guests are expected to have their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies recognition of inherent maritime risks and personal acceptance of responsibility for safety and health.
8. Modifications and Itinerary Changes
We reserve the right to adjust itineraries, travel paths, or schedules due to weather concerns, safety measures, or operational demands. We will make an effort to ensure alterations offer a similar grade of experience.
9. Force Majeure
We cannot be held accountable for postponements, cancellations, or changes stemming from unavoidable forces, inclusive of but not limited to:
- Extreme weather
- Natural catastrophes
- Regulatory mandates
- Harbor shutdowns
- Technical failures
10. Privacy and Data Protection
Your confidential data is managed in alignment with our Privacy Policy. Utilizing our services constitutes agreement to our data handling as detailed in the Privacy Policy.
11. Intellectual Property
The content found on our site, including text, graphics, logos, and imagery, is protected under copyright and trademark statutes. Unauthorized replication, distribution, or derivative work creation is prohibited without our explicit consent.
12. Governing Law
Legal interpretation of these Terms shall be in accordance with the laws of Monaco. Dispute resolution shall occur within the juridical venues of Monte Carlo, Monaco.
13. Changes to Terms
